These terms are the agreement between you and Cognio Lab LLC for using Sakhai. Please read section 3 in particular — it says what Sakhai is not, and that matters more here than in most software.
You must be 18 or older to hold an account. A younger person may use Sakhai within a household set up and supervised by a parent or guardian, who remains responsible for the account and for what is switched on. By using Sakhai you confirm you can enter into this agreement and that you are not barred from doing so under applicable law.
Sakhai is organised around a household: the person she talks with, and the family members paired to them. Whoever sets up a household is responsible for who is paired to it and for keeping their devices secure. A paired family member can turn capabilities on; the person using Sakhai is told what each one does and may refuse it. You agree not to pair a number belonging to someone who has not agreed to be paired.
Sakhai is a companion. She talks, remembers what you ask her to remember, keeps track of your day, reads what you show her, and — where you switch it on — sends messages, makes calls, finds things to buy and tells your family when something seems wrong.
She is not a medical device and not medical advice. She may remind you about medicine and note whether you said you took it. She does not diagnose, treat, or advise on any condition. Nothing she says is a substitute for a doctor, a pharmacist or a nurse.
She is not an emergency service. The emergency feature contacts the family members paired to the household. It does not contact 911, ambulances, police or fire services, and it depends on a working phone, a working network and a family member who answers. In an emergency, call your local emergency number. Do not rely on Sakhai to summon help.
She is not a carer, and not supervision. The quiet-phone alert tells your family that a phone has not been used for a while. It is not monitoring, it is not a fall detector, and a silent phone may mean nothing at all.
Sakhai answers using artificial-intelligence models. Those models can be mistaken, out of date, or confidently wrong. We have deliberately taken the things that must not be guessed at — your reminders, the date and time, what you asked her to remember — off the model entirely, and those are read from your device each time. Everything else, including anything she finds on the web, prices she reads from shops, flight times, what a letter says, and what a picture shows, you should check before relying on it, especially where money, health, travel or a deadline is involved.
With your permission she can act in the world: send WhatsApp messages, telephone a paired number, put an entry in your calendar, watch a shop's price, open a booking page, or pay for something. You are responsible for what she does at your instruction, in the same way you would be if you had done it yourself.
We build guards around this deliberately — she confirms before deleting anything, reads a purchase back before paying, asks a second time before money moves, and refuses anything you have not switched on — but no guard is perfect, and an automated assistant can act on a misheard instruction. If something matters, check it.
Where the Purse is switched on, you may authorise Sakhai to pay a specific total to a specific shop. Your card is held by Stripe, not by us. Each payment needs you to hear the real total and say yes, and the token she uses is valid only for that amount, at that shop, for a few minutes.
You are responsible for purchases you authorise. Your agreement for the goods themselves is with the shop, not with us — delivery, returns and refunds are between you and them. The limits you set are enforced by us on a best-effort basis and are not a guarantee against error.
By pairing a phone number you agree to receive WhatsApp messages and telephone calls from Sakhai at that number, including reminders you have asked for and alerts about the household. Message and data rates from your own carrier may apply. Send "forget this number" on WhatsApp to unpair, or turn the capability off.
You agree not to use Sakhai to send anyone messages they have not agreed to receive.
You agree not to: use Sakhai for anything unlawful; impersonate another person to her or through her; attempt to reach another household's data, server or conversations; probe, scan or interfere with the service; resell or repackage the service without our written agreement; use her to generate content that harasses, defrauds or endangers anyone; or use automated means to place load on the service beyond ordinary personal use.
Sakhai depends on services from other companies — Google, Meta, Twilio, Stripe and others listed in our Privacy Policy. Their availability is not in our control, their own terms apply to their part of the work, and anything she opens on your phone — a shop's page, an airline's booking page — is that company's to run and stand behind, not ours.
What you say to Sakhai, what she says back, and anything she makes for you — a card, a plan, a song — is yours. We claim no ownership of it, and we ask for no licence to it beyond what is technically necessary to deliver the service to you in the moment.
The software, the design, the name Sakhai and everything about how she works remain ours. Using the service does not give you any right in them beyond permission to use the service itself.
Some capabilities may be offered on a paid plan. Where they are, the price, the billing period and what is included will be stated at the time you subscribe, and you will be charged until you cancel. Fees already paid are not refundable except where the law requires it or where we say otherwise in writing. We may change prices for future periods with notice before the change takes effect.
You may stop using Sakhai at any time and ask us to close your household; when you do, we delete the household's server and what it holds, as described in the Privacy Policy. What is on your phone is deleted from your phone.
We may suspend or close an account that breaches these terms, that is being used to harm someone, or where we are required to. Except where the breach is serious or urgent, we will tell you first and give you a reasonable chance to put it right. We will not close a household without giving you a way to get what is yours out of it.
Except where the law does not allow it, Sakhai is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, that it will be free of error, or that anything it tells you will be correct or complete.
Except where the law does not allow it, neither we nor our suppliers will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or lost opportunity, arising out of your use of Sakhai — including any failure of a reminder, an alert or a message to arrive, and anything done or not done in reliance on something she said.
Our total liability arising out of or relating to these terms or the service is limited to the greater of one hundred US dollars or the amount you paid us in the six months before the event giving rise to the claim.
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
You agree to indemnify Cognio Lab LLC against claims, losses and reasonable costs arising from your use of Sakhai in breach of these terms, from anything you instructed her to do, or from your infringement of someone else's rights.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and we agree that any dispute will be brought in the state or federal courts located in California, and we each consent to their jurisdiction — except that either of us may seek injunctive relief anywhere it is needed to protect intellectual property or prevent misuse of the service.
Before filing anything, please write to moses@sakhai.care and give us thirty days to try to resolve it. Most things can be sorted out that way.
We may update these terms. If a change materially affects your rights we will tell you in the app before it takes effect, and the date at the top will move. Continuing to use Sakhai after that means you accept the new terms; if you do not, you may close your household.
